1. Framework


According to the GDPR, "Personal Data" is any "information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person".


2. Sources of Personal Data


This Policy applies to all Personal Data thatTrue Alpine Expirience collects from and about the User through the following sources:


-True Alpine Expirience websites - User-directed websites operated byTrue Alpine Expirience, including sites thatTrue Alpine Expirience operates under its own domains/URLs and mini-sites it uses on social networks such as Facebook;


-True Alpine Expirience mobile sites/apps - Mobile sites or applications directed at the User operated by or forTrue Alpine Expirience, such as smartphone applications;


- E-mail, text messages (SMS) and other electronic messages - Electronic communications between the User andTrue Alpine Expirience;


- Offline registration forms - Printed records and similar forms thatTrue Alpine Expirience collects through, for example, postal mail, in-store demonstrations, competitions and other promotions or events;


- Interactions with advertising - Interactions withTrue Alpine Expirience advertisements (for example, if the User interacts with one ofTrue Alpine Expirience's advertisements on third-party websites, we may receive information about this interaction);


- Data campaigns created byTrue Alpine Expirience - In the course of the User's interactions withTrue Alpine Expirience, we may create Personal Data about them (for example, records of purchases made on our website). Data from other sources - Third-party social networks (e.g. Facebook, Google) or market research (always with authorisation, and if the data has not been provided anonymously);



3. Subcontractors


Co-responsibility for processing Users' personal data begins from the moment the buyer pays for the selected product.


Whenever justified,True Alpine Expirience may use subcontractors, understood to be natural or legal persons who process personal data on its behalf, for which users of the Site hereby give their express consent.


Subcontractors may be used for the purposes of: managing the commercial relationship between Buyers and Sellers. It may also be necessary for the provision of sales and supply services, payment processing and invoicing, guaranteeing the execution of due diligence and back-office operations, namely in terms of the technical and operational support and assistance required for the operation of the Site, as well as all other matters that may prove necessary and/or convenient.


Subcontractors to whomTrue Alpine Expirience may have recourse shall implement all appropriate technical and legal measures to protect the personal data transmitted to them, in order to ensure the defence of the rights and interests of the respective data subjects.


4. Characterisation of the Collection and Processing of Personal Data


Depending on how the User interacts withTrue Alpine Expirience (online, offline, telephone, etc.),True Alpine Expirience collects various types of information, as follows:


- Personal contact details - This includes any information provided by the User which enablesTrue Alpine Expirience to contact them, such as their name, postal address, email address, social networking details or telephone number;


- Account access information - Any information required to access the User's account profile. This may include the User's login ID/email address, username, password in unrecoverable form and/or security question and answer.


- Demographic information and interests - Any information describing the User's demographic or behavioural characteristics. Such as date of birth, age or age group, gender, geographical location (e.g. postcode), products of interest, activities/hobbies, interests and household information and the User's lifestyle.


- Technical information about the computer / mobile device - Any information about the computer system or other technological devices that the User uses to accessTrue Alpine Expirience's Website or applications, such as the Internet protocol (IP) address used to connect the User's computer or device to the Internet, type of operating system and type and version of Internet browser. If the User accesses True Alpine Expirience website or application via a mobile device, such as a smartphone, the information collected will also include, where permitted, the device's unique ID, advertising ID, geographical location and other similar mobile device data.


- Information on the use of websites/communications - When the User browses throughTrue Alpine Expirience's websites or newsletters and interacts with them,True Alpine Expirience uses automatic data collection technologies to collect certain information on the User's actions. This includes information such as the links the User clicks on, the pages or content they view and for how long. Other similar information and statistics are also collected about your interactions, such as page response times, download errors and the duration of visits to certain pages. This information is captured using automated technologies such as cookies (browser cookies, flash cookies) and web beacons; information also collected through the use of third-party tracking. The User may object to the use of such technologies. For more details, see Section 4.


- Market research and User feedback - Includes information that the User voluntarily shares withTrue Alpine Expirience about their experience of using the products and services it offers.


- User-generated content. Refers to any content that the User creates and then shares withTrue Alpine Expirience on third-party social networks or uploads to one ofTrue Alpine Expirience's websites or applications, including the use of third-party social network applications such as Facebook. Examples may include photographs, videos, personal stories and so on. Where permitted,True Alpine Expirience may collect and publish User-generated content relating to a variety of activities, including competitions and other promotions, website attributes, User engagement and third-party social networks.


- Information from third-party social networks - This refers to any information that the User shares publicly on a third-party social network or information that is part of their profile on a third-party social network (such as Facebook) and that the User allows the third-party social network to share withTrue Alpine Expirience. Examples include the User's basic account information (e.g. name, e-mail address, gender, date of birth, current city, profile picture, user ID, friends list, etc.) and any other additional information or activities that the User allows the third-party social network to share.True Alpine Expirience receives the User's profile information from the third-party social network (or parts thereof) whenever the User downloads or interacts with an True Alpine Expirience application on a third-party social network, such as Facebook, or whenever the User interacts withTrue Alpine Expirience via a third-party social network. For more information on how User information on a third-party social network is obtained byTrue Alpine Expirience or to deactivate the sharing of such social network information, please visit the third-party social network's website.


- Payment and financial information - Any information that the User uses to make a purchase or place an order, such as debit or credit card details (cardholder name, card number, expiry date, etc.) or other forms of payment (if available).True Alpine Expirience or its payment processing service providers will handle payment and financial information in accordance with applicable laws, regulations and security standards.


5. Those responsible for processing personal data


True Alpine Expirience shall be responsible for processing any personal data transmitted in connection with the use of the Site, regardless of its nature or ownership, in relation to the following personal data of Buyers:


- First and last name - for the purposes of identifying Buyers;


- Address and postcode - for the purposes of sending the products purchased by the Buyers;


- E-mail address - for contact purposes;


- Telephone and/or mobile phone number - for contact purposes (if necessary and requested);


- Tax identification number (TIN) - for tax purposes and for commercial transactions, invoicing and payment.


6. Collection and processing of personal data


Access to and mere use of the Site by Users does not in itself imply the collection or processing of any personal data. However, whenever the User creates an account on the Site, data will be collected, varying according to the purpose. The purposes for which data is collected and processed can be found in point 4 of this Policy.


7. Transfers of personal data

In certain situations, personal data transmitted by Users of the Site may be transferred to other entities that provide services toTrue Alpine Expirience.


8. Rights of personal data subjects


Website Users are guaranteed the right to access, rectify, withdraw consent, oppose processing for the purposes defined above, erase, limit and portability of the personal data they have transmitted.


The aforementioned user rights may be exercised at any time by sending written requests to the representative of the Data Controller a info@truealpineexpirience.com, attaching proof of identification.


If the request is sent by a person other than the Consumer, without providing proof that the request was legitimately made on their behalf, it will be rejected.

Without prejudice to the foregoing, users of the Site who have transmitted their personal data may also lodge a complaint with the National Supervisory Authority (Comissão Nacional de Proteção de Dados - CNPD), whose contact details can be found at www.cnpd.pt.


Please note that, in certain circumstances,True Alpine Expirience will not be able to delete the Consumer's Personal Data without also deleting their user account.True Alpine Expirience may be obliged to retain some of the Consumer's Personal Data after the Consumer has requested deletion, in order to fulfil its contractual or legal obligations.True Alpine Expirience may also be authorised by applicable laws to retain some of the Consumer's Personal Data to meet its commercial needs.


9. Personal data retention period


True Alpine Expirience will take reasonable steps to ensure that Personal Data is only processed for as long as is necessary to fulfil the purposes set out in this Privacy Policy.

Thus, the personal data collected and processed byTrue Alpine Expirience will be kept for as long as the User's registration on the Site remains active.

When the user's registration on the Website is terminated, the personal data transmitted toTrue Alpine Expirience will be kept for up to one (1) year from that date, unless another retention period is required by applicable law.


However, as mentioned above, the User of the Site may at any time requestTrue Alpine Expirience to delete the personal data it has transmitted.


10. Security measures


In order to ensure the storage and protection of data,True Alpine Expirience adopts the following security measures:


- Encryption of all personal data transmitted to it;


- Mandatory use of a personal password for each User;


- Greater care is taken with data relating to Users' debit or credit cards. This type of data will not be stored, thus ensuring that third parties cannot access or use it;


- Constant checking and updating of computer servers in order to reduce any chance of attack or vulnerability.


NOTE: Measures to be adopted by the Consumer:


It is important that the Consumer also takes an active role in keeping their Personal Data safe and secure. When signing up for an online account, you should choose a password that is relatively complex so that others cannot guess it. You should never reveal your password to third parties. You are responsible for any use of your account and for keeping this password confidential. If you use a shared or public computer, you should never select the option to remember your login details, e-mail address or password.

You should also make sure that you log out every time you leave the computer in question. The Consumer should make use of any privacy settings or controls thatTrue Alpine Expirience provides on its website or applications.
